Kishtwar Minor Rape Case: J&K Government ने Teacher को Service से किया Dismiss
Jammu and Kashmir government ने Kishtwar district के एक government school teacher को service से immediate effect के साथ dismiss कर दिया है। Teacher पर एक 14-year-old minor tribal girl को कई महीनों तक sexual assault करने का आरोप है।
आरोपी teacher Khalid Hussain, Teacher Grade-II, Government Middle School Bumalpora, Gurinalla, Zone Inderwal, District Kishtwar का था। Government ने Article 311(2)(b) of the Constitution invoke किया है।
School Education Department ने Government Order No. 388-JK (Edu) of 2026 dated 21.09.2026 जारी किया। Order पर Commissioner/Secretary Ram Niwas Sharma के signature हैं।
Government ने कहा कि FIR No. 34/2026 at Police Station Chatroo register हुई है। यह case Sections 61(2), 65(1), 90, 91 और 92 of Bharatiya Nyaya Sanhita (BNS) 2023 के तहत दर्ज है।
Protection of Children from Sexual Offences (POCSO) Act, 2012 की Sections 4, 6, 8, 10 और 17 भी लगाई गई हैं। Government ने record पर available material के आधार पर major penalty लगाना जरूरी माना।
Order में कहा गया कि departmental inquiry hold करना reasonably practicable नहीं था। Case को ‘rarest of rare cases’ की category में रखा गया।
Government ने observe किया कि teacher की continued employment government interests के लिए detrimental होगी। इससे government institutions में public trust भी erode होगा।
Dismissal के बाद Khalid Hussain future में किसी भी government department में employment के लिए ineligible हो गया है। वह पहले से suspension पर था और judicial custody में है।
Education Minister Sakina Itoo ने X पर post किया। उन्होंने कहा, ‘The safety of our children is paramount. Schools are institutions of trust, and anyone who violates that trust will face the strongest action permissible under law. As committed by the Chief Minister, the Government has taken decisive action in the horrific Kishtwar case involving a minor girl.’
Itoo ने आगे कहा, ‘Every child deserves a safe school and a secure environment to learn and grow. No compromise. No exceptions.’
इस case में अब तक 10 accused arrest हो चुके हैं। Kishtwar Police ने पहले Special Investigation Team (SIT) बनाई थी। बाद में Crime Branch Jammu ने investigation takeover किया।
Investigation में पता चला कि आरोपी teacher ने minor student को कई महीनों तक sexually assault किया। इससे victim pregnant हो गई।
Victim की death 20 August 2026 को हुई। Death abortion procedure के दौरान complications से हुई। Victim Gujjar-Bakarwal community से belonged करती थी।
Crime Branch ने local Gujjar leader Peer Baksh को भी arrest किया। आरोप है कि Baksh ने victim के family को silence कराने की कोशिश में help की।
Hospital records में victim को 13-year-old boy की wife दिखाया गया था। इस matter की भी scrutiny मांगी गई है।
Victim के father ने High Court में plea file की थी। Plea में Crime Branch probe की demand की गई। Senior advocate Deepika Pushkar Nath ने petition file किया।
Plea में alleged panchayat intervention की भी जांच मांगी गई। आरोप है कि victim के father पर compromise के लिए pressure डाला गया।
Family ने आरोप लगाया कि uneducated father से blank paper पर thumb impression लिया गया। Money offer करने का भी allegation है।
Daily-wage worker Kishtwar district hospital का भी इस case में role सामने आया। Government ने उसे भी service से dismiss किया था।
Criminal investigation और trial law enforcement authorities के through law के according चल रही है।
