PSA Detention Case: High Court ne detention orders ko kiya रद्द
J&K High Court ne kaha- purane allegations ke basis par personal liberty nahi छीनी जा सकती
PSA Detention Case mein Jammu Kashmir and Ladakh High Court ne बड़ा फैसला सुनाया hai। High Court ne Public Safety Act (PSA) ke तहत लगाए गए do preventive detention orders ko रद्द कर दिया aur dono detainees ko तुरंत रिहा करने के निर्देश दिए।
High Court of Jammu & Kashmir and Ladakh ke Justice Rahul Bharti ne kaha ki पुराने allegations aur stale grounds ke basis par kisi ki personal liberty ko नहीं छीना जा सकता।
PSA Detention Case mein HC ka bada फैसला
Court ne Sopore ke रहने वाले Irfan Majeed Lone aur Bandipora ke Suhail Ahmad Parray ke खिलाफ लगाए गए PSA detention orders ko illegal karar diya।
Irfan Majeed Lone ke खिलाफ detention order District Magistrate Baramulla ne April 2025 mein जारी किया tha। वहीं Suhail Ahmad Parray ke खिलाफ Bandipora administration ne May 2025 mein PSA order pass kiya tha।
High Court ne kya कहा?
High Court ne case ki सुनवाई ke दौरान कहा ki authorities ne जिन पुराने मामलों aur allegations ka use kiya, वे preventive detention justify karne ke liye काफी नहीं थे।
Court ne साफ कहा ki ये matter “law and order” se जुड़ा ho sakta hai, लेकिन इसे “public order” ka issue batakar PSA lagana सही नहीं hai।
Justice Rahul Bharti ne कहा कि preventive detention ka इस्तेमाल punishment dene ke liye नहीं किया जा सकता।

Dono detainees ki release ka आदेश
Court ne dono detention orders ke saath Government approval orders ko bhi रद्द कर दिया। इसके बाद jail authorities ko निर्देश दिए गए ki dono detainees ko तुरंत release kiya जाए।
High Court ke is फैसले ko personal liberty aur legal rights ke नजरिए से काफी अहम माना जा रहा hai।
